TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of glokinlabs.com (the “Site”) and your purchase of products from Glokin Labs LLC, doing business as Glokin Labs (“Glokin Labs,” “we,” “us,” or “our”).

By accessing the Site, placing an order, or using our services, you agree to these Terms. If you do not agree, please do not use the Site or purchase our products.

1. Online Store Terms

You must be at least the age of majority in your state, province, or country of residence to purchase from the Site. If you permit a minor to use a product purchased from us, you are responsible for supervising that use.

You may not use our products, Site, or services for any unlawful or unauthorized purpose. You may not introduce viruses, malicious code, or other material intended to interfere with the Site.

2. Product Information

We make reasonable efforts to display product descriptions, colors, finishes, weights, dimensions, photographs, and specifications accurately. Screen settings, lighting, production variations, and manufacturing tolerances may cause minor differences between the product shown and the product received.

Product photographs are illustrative. Unless expressly stated on the product page, accessories, hooks, rigging, fishing line, rods, reels, or other items appearing in photographs are not included.

We may modify or discontinue products without notice. Product availability is not guaranteed.

3. Fishing Tackle Safety and Proper Use

Fishing equipment can cause serious injury. Hooks, sharp components, heavy lures, fishing line, casting equipment, and improperly secured tackle may create puncture, impact, entanglement, choking, or other hazards.

You are responsible for:

  • Inspecting products before each use.

  • Using appropriate protective equipment, including eye protection when appropriate.

  • Keeping fishing tackle away from children and pets.

  • Selecting tackle appropriate for your equipment, target species, conditions, and experience.

  • Following all applicable fishing, boating, environmental, and wildlife laws.

  • Discontinuing use of any product that appears damaged, cracked, excessively worn, or unsafe.

Product-specific safety or chemical warnings displayed on a product page, label, or package form part of the product information and should be followed. Nothing in our marketing constitutes a promise or guarantee that a product will catch fish or produce a particular fishing result.

4. Orders and Order Acceptance

Submitting an order does not guarantee acceptance. We may reject or cancel an order because of inventory discrepancies, suspected fraud, incorrect pricing, payment problems, shipping limitations, product restrictions, or other legitimate business reasons.

An order is accepted when we send confirmation that it has been processed or shipped.

If we cancel an order after payment has been collected, we will refund the affected amount to the original payment method. Depending on the financial institution, the refund may take additional time to appear.

We may limit quantities purchased per person, household, account, payment method, or order.

5. Prices, Payment, and Taxes

Prices are displayed in the currency shown on the Site and may change without notice. The price charged will be the price displayed at checkout when the order is submitted, except where an obvious pricing or technical error has occurred.

Applicable taxes, shipping charges, and other authorized charges will be displayed at checkout before the order is submitted.

You represent that the payment and billing information you provide is accurate and that you are authorized to use the selected payment method.

Discounts and promotional codes have no cash value, may not be combined unless expressly permitted, and may be modified or discontinued as allowed by law.

6. Shipping

Orders completed before 3:30 p.m. Pacific Time will normally ship the same business day.

Glokin Labs ships Monday through Friday, excluding federal holidays. Orders completed after the cutoff, on weekends, or on federal holidays will normally ship the following business day.

Available shipping services, charges, and destinations are displayed at checkout. Free shipping may be offered on qualifying orders over $200 when shown at checkout.

Delivery dates are estimates and are not guaranteed. Carrier delays, weather, emergencies, incorrect addresses, customs processing, and circumstances outside our reasonable control may affect delivery.

Tracking information may take up to 24 hours after shipment to begin displaying carrier activity.

Customers are responsible for entering a complete and accurate delivery address. If a package is returned because of an incorrect or incomplete address, additional shipping charges may apply before it is resent.

Lost, missing, or significantly delayed shipments will be reviewed with the carrier. We may require the customer’s cooperation with a carrier investigation before providing an available remedy.

7. Final-Sale Policy, Damaged Products, and Order Problems

Except where required by law, purchases are final sale. We do not accept returns or exchanges because of a change of mind, an incorrectly selected color, size, style, or weight, or because the customer no longer wants the product.

If an item arrives damaged, defective, or different from the item ordered, contact us within seven calendar days of delivery and provide the order number and clear photographs of the item and packaging.

When a claim is approved, we will ordinarily provide a replacement first. If a replacement is unavailable, we may provide store credit or a refund. Do not return a product unless we provide return instructions. Glokin Labs will pay approved return-shipping costs when a return is required because of our error or an approved product problem.

Normal wear, cosmetic wear resulting from use, lost tackle, damage caused by fish, rocks, structure, corrosion, improper storage, misuse, unauthorized modification, or use inconsistent with the product’s intended purpose is not considered a manufacturing defect.

Cancellation requests should be submitted within one hour of placing an order. We cannot guarantee cancellation after an order enters processing or ships.

8. Promotions and Giveaways

Promotions, giveaways, contests, and special offers may have additional rules. If additional rules conflict with these Terms, the specific promotion’s rules will control for that promotion.

We may cancel or modify a promotion when fraud, technical problems, abuse, or circumstances outside our reasonable control affect its proper operation, subject to applicable law.

9. Intellectual Property

The Site and its contents—including the Glokin Labs name, logos, product names, product designs, photographs, graphics, videos, written material, and website layout—are owned by or licensed to Glokin Labs and are protected by applicable intellectual-property laws.

You may use the Site for personal, noncommercial shopping purposes. You may not copy, reproduce, republish, sell, distribute, modify, create derivative works from, or commercially exploit our content without prior written permission.

Nothing in these Terms transfers ownership of our intellectual property to you.

10. Reviews, Photographs, and Customer Content

If you voluntarily submit a review, photograph, video, testimonial, comment, or other content to Glokin Labs, you confirm that you own or have permission to submit it and that it does not infringe another person’s rights.

You grant Glokin Labs a nonexclusive, worldwide, royalty-free license to display, reproduce, resize, edit for formatting, and share that content through our Site, organic social-media channels, email communications, and other Glokin Labs-owned channels for purposes connected with operating and promoting the business.

We will obtain separate permission before using identifiable customer content as the primary creative in paid advertising.

You retain ownership of your content. We may remove customer content that is unlawful, misleading, abusive, infringing, or otherwise inappropriate.

11. Prohibited Conduct

You may not:

  • Use the Site for unlawful, fraudulent, or abusive activity.

  • Violate intellectual-property or privacy rights.

  • Submit false or misleading information.

  • Attempt unauthorized access to the Site, customer accounts, or connected systems.

  • Scrape, harvest, or systematically collect Site data without permission.

  • Interfere with Site security or operation.

  • Use automated purchasing methods to circumvent product or quantity limits.

  • Resell products in a manner that falsely suggests authorization or affiliation with Glokin Labs.

We may suspend access, cancel orders, or take other reasonable action in response to prohibited conduct.

12. Third-Party Services and Links

The Site may use or link to third-party services, including Shopify, payment processors, carriers, social-media platforms, and other providers.

We are not responsible for third-party websites, services, content, availability, or privacy practices. Your use of a third-party service may be governed by that provider’s terms and policies.

13. Privacy

Our collection, use, and disclosure of personal information are governed by our Privacy Policy:

Payment information may be processed by Shopify or an authorized payment provider. Glokin Labs does not receive or store complete payment-card numbers when they are handled by those providers.

14. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Site and services are provided on an “as is” and “as available” basis.

We do not warrant that the Site will always be uninterrupted, secure, or error-free. We do not guarantee particular fishing results, catch rates, product availability, delivery dates, or that a product will be suitable for every fishing condition or application.

Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Glokin Labs and its owners, employees, contractors, affiliates, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Site or products.

Where liability cannot legally be excluded, our total liability relating to a product or order will not exceed the amount paid for the product or order giving rise to the claim, except where applicable law requires otherwise.

This limitation does not apply to liability that cannot legally be limited, including liability for fraud, intentional misconduct, or personal injury where exclusion is prohibited by law.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold Glokin Labs harmless from third-party claims, losses, or expenses arising from your unlawful misuse of the Site, violation of these Terms, infringement of another person’s rights, or unauthorized modification or misuse of a product.

This section does not require you to indemnify Glokin Labs for our own negligence, unlawful conduct, or other responsibility that cannot legally be transferred.

17. Errors and Corrections

The Site may occasionally contain typographical errors, inaccurate information, or omissions concerning descriptions, prices, promotions, shipping charges, transit times, or availability.

We may correct errors and update information. If a material correction affects an order you have already submitted, we may contact you for approval or cancel and refund the affected order.

18. Governing Law

These Terms and purchases from Glokin Labs are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.

If you are entitled to mandatory consumer protections under the laws of your place of residence, these Terms do not remove those protections.

Before filing a legal claim, you and Glokin Labs agree to make a reasonable good-faith effort to resolve the matter by contacting the other party. This does not prevent either party from seeking urgent relief or exercising a right that cannot legally be restricted.

19. Changes to These Terms

We may update these Terms to reflect changes to our business, products, services, or legal obligations. The revised Terms will be posted on this page with an updated effective date.

Changes apply prospectively unless applicable law requires otherwise. The Terms in effect when an order is placed will generally govern that order.

20. Severability and Entire Agreement

If a provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

These Terms, together with the policies referenced in them and any product-specific or promotion-specific terms, constitute the agreement between you and Glokin Labs regarding use of the Site and purchases from us.
